VILNIUS—Alan Dershowitz, often deemed to be America’s leading constitutional lawyer, confirmed to Defending History this morning that the following statement, that has been circulating in emails and social media, is wholly accurate. This is the precise text sent to DH by Professor Dershowitz:

“The 2015 Seimas resolution green-lighting the conference center on the Shnipishok cemetery in Vilna, Lithuania, undermines the provisions of the Lithuanian Constitution, Articles 22 and 26. These respective provisions in the Constitution protect religious freedom and religious institutions.

“Beyond raising a compelling constitutional issue, this resolution is wrong as a matter of justice, historical preservation, basic decency and the dignity of the dead.”

83 Descendants of People Buried in Old Vilna Jewish Cemetery File Appeal; London’s CPJCE and the AJC are Cited as ‘Authorities’



VILNIUS—The following are excerpts in English translation (from the original Lithuanian text) of the 9 June 2021 Appeal filed by 83 plaintiffs still recognized by the court as having proper standing, out of the original 157 claimants, all descendants of persons buried in the Old Vilna Jewish Cemetery at Piramónt (Shnípishok, in today’s Šnipiškės district). These people, whose ancestors paid for their burial plots in freehold perpetuity, do not understand how an EU/NATO member country could plan to cite a national convention center on land surrounded by these graves on all four sides. These excerpts from the translation are limited to paragraphs explicitly citing the London-based “Committee for the Preservation of Jewish Cemeteries in Europe” (CPJCE) which is alleged to accept secret large payments in return for their “permissions and supervisions” of the wanton business-and-profit-led destruction of major Jewish cemeteries in Eastern Europe.

As detailed in Defending History’s report last week concerning the 10 May 2021 court verdict, the CPJCE’s role has been roundly rejected and condemned by virtually all leading Litvak (Lithuanian tradition) Jewish rabbinic authorities and institutions internationally. The CPJCE has moreover been banned explicitly from further involvement in the Vilnius fiasco by decree of the Conference of European Rabbis duly reported to the former Lithuanian minister of culture, making it clear that the London group has no standing to be representing anyone in the saga.

Thank you once again to all who wrote emails to Lithuania’s Parliament (Seimas) to oppose the financing of the reconstruction of the Vilnius Concert and Sports Building Complex which the Soviets built in the heart of the oldest Jewish Cemetery in Vilnius at Piramont-Šnipiškės. As things stand, the budget for 2021 includes 515,000 euros to organize the contests to select the operator and the contractor for the complex, and further foresees 16,685,000 euros in 2022 and 10,173,000 euros in 2023 for the building works involved.

We now need to write letters to Lithuania’s Finance Ministry and even the President of Lithuania. Today, December 11, 2020, the new Government has been sworn in, including the Finance Minister. This new Government will have just a few days to revise the budget for 2021 before it returns it to Seimas on December 17 for the second review.

For years now, millions of dollars/euros have been squandered on the morally corrupt leadership of passport attorney Ms. Faina Kukliansky, who has disenfranchised the Jews of Lithuania by changing the election rules of the official Jewish Community three years ago into a vote by cronies who themselves mostly receive benefits from the Good Will Foundation, which she herself co-chairs, making it unclear which is the bigger conflict of interest: that of the attorney who needs the gov. to rapidly process her wealthy foreign clients’ citizenship applications, or the Good Will Foundation and the official Jewish Community becoming one and the same complex of restitution resources being diverted to the benefit of the same few parties.

There is by now a large list of sources on the de-democratisation, extreme nepotism and supreme shamefulness (and shamelessness) of the Good Will Foundation’s process for disbursing funds deriving from the value of the religious properties of the annihilated Jews of Lithuania. To cite one of many examples, the official trilingual website of the official community has repeatedly been used as a mouthpiece for Turto Bankas’s and some politicians’ wish to turn the Old Jewish Cemetery into a convention centre, in spite of massive local and international protest, (an international petition by one the Vilnius Jewish Community’s members is approaching 52,000 signatures). The website has been used (in three languages) to slander those community members who disagree. The Good Will Foundation has failed to provide even one penny of support it promised for the democratically elected Vilnius Jewish Community. In a recent reply to a television exposé, the GWF website explained that in reality all decisions go through two boards with eminent international members representing the great international Jewish organisations.

We contend that these international members, enjoying banquets, junkets and honours (sometimes even medals) in Vilnius (and who, unlike locals, have absolutely nothing to fear in the way of career-destroying repercussions) have in fact served as an unethical rubber stamp for the personal benefit of Ms. Kukliansky and her collaborators. They have been assured that their names will remain on some obscure web page. Well, no longer. In the absence of change of policy, we hold each of them as co-equally responsible for the tragic “destruction from within” of Lithuania’s small and fragile Jewish community, and of the oldest and largest Jewish cemetery in Lithuania, all for the private ambitions of one wealthy lawyer and immediate relatives, and a circle of cronies. We call on you to speak out with force and ethical clarity.

Vilnius Braces for May 7th “Jewish Cemetery Trial of Century”; Around 160 Plaintiffs Recognized by Court

VILNIUS—At a hearing at the District Court of Vilnius City, at Laisves Prospect 79A on Monday, the presiding judge set Thursday May 7th 2020 as the date of the trial over plans of the state-financed property bank, “Turto Bankas” to establish a national convention center in the heart of the Old Vilna Jewish Cemetery. The plaintiffs in the case are Jewish people whose ancestors and relatives are still buried in the old cemetery, at Piramónt (in the Šnipiškės district of modern Vilnius). Of hundreds of claims submitted, sources close to the court reported that “around 160” have been accepted as legal plaintiffs for the trial, which is expected to attract expert witnesses from the United States and Israel as well as foreign media interest. There has been extensive international opposition to the convention center project, including impassioned pleas from major Lithuanian-origin rabbis internationally, most recently the doyen of Litvak rabbis, Rabbi Chaim Kanievsky, a nephew of Vilna’s prewar Chazon Ish. A petition by Vilnius native Ruta Bloshtein has garnered some 47,000 signatures.

NEW YORK CITY—A New York Institute of Technology professor of physics, Prof. Bernard Fryshman, who is also one of the world’s major advocates for the preservation of endangered minority cemeteries (he helped the US Congress draft its 2014 resolution on the subject) has teamed up with Boruch Pines, a New York based descendant of many persons buried in the old Vilna Jewish cemetery at Piramónt in the Šnipiškės (Yiddish: Shnípeshok) district of modern Vilnius, capital of Lithuania. Together, they filed suit in the United States District Court for the District of Columbia on 8 November 2018. WASHINGTON DC—Three United States senators, Benjamin L. Cardin (Maryland, D.), Pat Roberts (Kansas, R.), and  James E. Risch (Idaho, R.) today wrote to Lithuania’s president, Dalia Grybauskaitė, appealing to her to move the planned national convention center away from the old Vilna Jewish Cemetery to another venue. It follows a similar appeal by twelve members of the American Congress last summer, a wide range of religious, community and religious figures and institutions internationally, and a recent statement to The New York Times by the elected head of the Vilnius Jewish Community, representing the vast majority of Lithuania’s surviving Jewish citizens. Vilnius native and resident Ruta Bloshtein, a prominent figure in Lithuania’s small Orthodox Jewish community, initiated a petition signed by close to 44,000 people internationally.

As anyone who has been following events in Lithuania for the last several years surely knows by now, the country sports street names and monuments honoring locals who collaborated with the Nazis during World War Two. It was in this context that I attended an event in Washington, DC yesterday at the Wilson Center’s Kennan Institute discussing Ruta Vanagaite’s controversial book “Our People” (it appeared in Lithuanian in 2016) that blows open the door describing the true extent of Lithuanian collaboration in the Holocaust. Vanagaite and her co-author Efraim Zuroff , director of the Simon Wiesenthal Center’s Israel Office, spoke at the event.

Summer’s Cool New Vilnius Poster to Save Old Vilna Jewish Cemetery

VILNIUS—For the first time in the history of modern Lithuania, a non-Jewish campaign initiative for a Jewish cause has seen its poster flood the streets of this city’s storied Old Town at the height of the summer tourist season. Conceived and produced by Julius Norwilla (Norvila), a former Protestant minister, using a quote from Dr. Andrius Kulikauskas, a Catholic philosopher, and based on an artistic visualization of a young Vilnius artist who supports the campaign, the poster is entitled “Vilnius Without its Ugliest Soviet Eyesore”. That is a reference to the hated ruin of the Soviet Sports Palace which stands in the middle of the old Vilna cemetery, where the city’s Jewish residents were buried in graves paid for by their families as freehold property, from the 15th to the 19th century. The poster makes reference to Vilnius native Ruta Bloshtein’s international petition, which is, at 40,000 signatures to date, arguably the largest Litvak initiative since the Holocaust. Members of Lithuania’s Jewish community who have spoken out to date include Moyshe Bairak, Ruta Bloshtein, Milan Chersonski, Pinchos Fridberg, Dovid Katz, and Josif Parasonis (more here). Current and recent rabbis in Vilnius who have taken a public stand include Chaim Burshtein, Shmuel Jacob Feffer, Kalev Krelin, and Sholom Ber Krinsky.

Vilnius Resident Launches Petition on City’s Old Jewish Cemetery

VILNIUSRuta Bloshtein, a native and resident of the Lithuanian capital, and stalwart of its small Orthodox community, has launched an international petition via Change.org asking the leaders of Lithuania to move the project for a national convention center away from the old Jewish cemetery at Piramónt where many thousands of the city’s Jewish citizens were buried from the 15th to the 19th centuries. It is one of East European Jewry’s most sacred sites. Many of its gravestones were lovingly preserved or renewed right up to the Holocaust, in which around 99% of Vilna’s Jewish community perished.

Massive New Vilnius Construction Site: Within or Bordering City’s Old Jewish Cemetery?

VILNIUS—A massive new construction site is being dug up next door to the Soviet-era Sports Palace building in the Šnipiškės section of Vilnius. The former Sports Palace, now the subject of intense international debate over plans for a 25 million dollar conversion into a national conference center, itself “indisputably rests in the middle of the former cemetery,” as confirmed by the United States government a decade ago. But what is unknown is where that may leave this bordering site, which may or may not lie outside various hypothesized boundaries of the old Vilna Jewish cemetery, in use from the late fifteenth century to the 1830s. The last generations of pre-Holocaust Vilna Jewry called the cemetery Piramónt.

KIRYAS JOEL, NYThe “Satmar Headquarters” of the movement’s “Aaronite” branch, partners of the London-based “CPJCE / Admas Kodesh” issued this tweet earlier today, which some observers take to convey the message that the politically connected Hasidic group continues to boast of preventing the “United States Commission for the Preservation [emphasis added] of America’s Heritage Abroad” from expressing even the mildest protest at plans to erect a twenty-five million dollar convention center in the heart of Vilnius’s oldest Jewish cemetery. With the exception of the CPJCE, exposed in Wikileaks as having demanded money for their “supervision” at the same cemetery in 2009 (see Jerusalem Post and JTA reports), major rabbis and rabbinic associations, alongside a variety of Jewish and non-Jewish figures, have expressed unanimous condemnation of the project.

The condemnations include the major groups of Lithuanian (Litvak) rabbis internationally, and also the rival branch of Satmar itself, the “Zalmanite” branch, whose own highest rabbinic court last summer added its voice to the Lithuanian rabbis worldwide. Vilnius has numerous venues appropriate for the new convention center. Some observers remain baffled at the insistence on the old cemetery site, where thousands of graves lie intact, and where revelers would clap, cheer, and use bars and toilets surrounded by a half millennium’s Jewish graves, including major Jewish scholars of the city, historically Vilna, once known as the Jerusalem of Lithuania.
